From time to time, ESB Energy may introduce location-specific, time-limited or promotional tariffs, including tariffs available only at designated sites or during defined time periods.

Details of such tariffs, including eligibility, applicable locations, pricing and duration, will be set out in the relevant Appendix or tariff schedule and form part of these Terms & Conditions.

These tariffs may be amended, suspended or withdrawn by ESB Energy at any time, in accordance with its standard Terms & Conditions.

Amendments

ESB Energy reserves the right to amend these Terms & Conditions at any time. Any changes will be communicated in accordance with ESB Energy’s tariff Terms & Conditions.

Appendix

1. Hackney Light & Power Plan: (HLP) – Terms & Conditions

These Terms & Conditions apply to customers enrolled on the Hackney Light & Power Plan and form part of ESB Energy’s tariff Terms & Conditions. The HLP Plan is delivered in partnership with Hackney City Council to support eligible Hackney EV permit holders with residential EV charging only.

1. Eligibility and Verification

Eligibility is determined by Hackney City Council and verified during signup via the ESB Energy EV Plug In app. Eligibility may be reviewed periodically at ESB Energy’s discretion, and access may be withdrawn, suspended, or modified at any time if eligibility requirements are no longer met or reasonably suspected not to be met.

2. Right to Refuse, Suspend or Withdraw Access

ESB Energy reserves the right, at its sole discretion, to refuse, suspend, or withdraw access to the HLP Plan where:

  • eligibility cannot be verified or is withdrawn;

  • false, misleading, or incomplete information is provided;

  • charging behaviour is inconsistent with typical private residential use;

  • these Terms & Conditions are breached; or

  • ESB Energy is instructed to do so by Hackney City Council.

These rights may be exercised without prior notice where required for operational, compliance, or network‑related reasons.

Where access is refused or withdrawn, the customer may be notified and offered the option to transfer to an alternative ESB Energy tariff or close their account, in accordance with these Terms & Conditions.

3. Eligible Chargers

The Hackney Light & Power (HLP) tariff applies exclusively to Hackney‑funded rapid chargers located within the London Borough of Hackney.  Two Transport for London (TfL)‑owned rapid chargers, located at 113 Upper Clapton Road and 88 Stamford Hill, may also be included at ESB Energy’s discretion, notwithstanding that they are not Hackney‑funded. The HLP tariff does not apply to any other chargers on the ESB Energy network.

The inclusion of TfL‑owned chargers is not guaranteed and may be amended or withdrawn at any time without prior notice.

3.1 Ineligible Chargers

The HLP tariff is not available on fast or ultra‑rapid chargers.

Charging undertaken on fast or ultra‑rapid chargers will be charged at standard ESB Energy Pay as You Go (PAYG) rates, regardless of customer eligibility for the HLP Plan.

ESB Energy may add, remove, or amend eligible chargers at its sole discretion, including non‑Hackney‑funded chargers and third‑party chargers.

3.2 Usage Charges

Applicable charging rates under the Hackney Light & Power Plan are set out in the Price Plan Table above. This includes Day Tariff and Night Tariff rates for eligible Hackney chargers, as well as rates applicable when charging outside the London Borough of Hackney. Night Tariff rates apply between 01:00 and 05:00. Customers should refer to the Price Plan Table for the current applicable rates.

All prices are subject to change in accordance with ESB Energy’s Terms & Conditions.

4. Payment and Account Management

The HLP Plan operates on a PAYG basis.

  • No subscription or connection fees apply

  • Customers pay only for the electricity used to recharge their EV

  • Sign‑up and payment are completed via the EV Plug In app

  • Credit can be loaded in multiples of £10

  • The minimum balance required to start a charge is £5

5. Charge Point Access Cards

One charge point access card is provided free of charge as part of the Hackney Light & Power Plan. Replacement or additional access cards are available at a cost of £10 per card.

6. Volume Cap and Fair Usage

The HLP Plan is intended for typical private residential use. A rolling cap of 1,500 kWh per 12‑month period applies. ESB Energy may apply PAYG rates, migrate to tariffs, suspend or terminate access where usage exceeds the cap or is inconsistent with residential patterns.

Charging activity that materially exceeds these levels or indicates sustained usage inconsistent with private residential driving behaviour, may be deemed non‑compliant with the intended use of the tariff.

Where reasonably practicable, customers may be notified in advance. Continued use of the charging network following notification constitutes acceptance of the revised rates or tariff conditions.

7. Fair Usage Clause

7.1 Expected Use

Customers must:

  • use charge points solely for EV charging;

  • charge only for the time required; and

  • disconnect and vacate the charger once charging has completed, including during the 01:00–05:00 discounted period.

7.2 Unreasonable or Excessive Use

Usage may be deemed unreasonable where a customer:

  • remains connected significantly beyond charge completion;

  • uses a charger as an overnight parking location or remains plugged in while not charging;

  • attempts to access HLP rates outside eligibility rules; or

  • displays behaviour inconsistent with normal private residential charging patterns.

8. Overstay Fees

Overstay fees of £0.75 per minute apply after 60 minutes on rapid chargers. The maximum overstay fee is £35 per charging session. Fees apply regardless of whether charging occurs during the discounted night‑rate period.

9. Monitoring and Enforcement

ESB Energy may monitor charging behaviour and may automatically apply fees, issue warnings, suspend access, or terminate accounts without further notice for serious or repeated breaches of these Terms & Conditions.

10. Loss of Eligibility

Where a customer ceases to meet the eligibility requirements for the HLP Plan, ESB Energy may, at its discretion, notify the customer and allow a period of up to 30 days to transfer to an alternative ESB Energy tariff or to close their account.  Where the customer fails to respond within this period, ESB Energy may transfer the customer to the Pay as You Go tariff without further notice

11. Amendments

ESB Energy may amend these Hackney Light & Power Plan Terms & Conditions to reflect operational requirements or obligations with Hackney City Council.  Any changes will be communicated in accordance with ESB Energy’s tariff Terms & Conditions.

2. AC Night Tariff (Birmingham Only)

This tariff is available on selected ESB Energy AC charge points (=<43kW) at participating Birmingham City Council ("BCC") locations and forms part of ESB Energy's standard Terms & Conditions.

The AC Night Tariff is available to PAYG, Membership, Fleet, Taxi and OCPI customers only. It does not apply to charging sessions started using Contactless payment or One Time Payment via the EV Plug In app. These charging sessions will be charged at the applicable standard rates set out in the Price Plan Table, regardless of the time of charging.

Night Tariff rates apply to charging sessions between 21:00 and 07:00. Standard Day Tariff rates apply to electricity consumed outside these hours. Where a charging session spans both periods, charges will be calculated according to the electricity consumed during each applicable tariff period.

The tariff is only available at participating Birmingham City Council locations and is not available at the following sites: Boldmere Gate Car Park; Cannon Hill Park (Russell Road); Cotteridge Park Car Park; Sparkhill St. Paul's Road Car Park; Ward End Park Car Park; Dudley Street Car Park; Jewellery Quarter Multi-Storey Car Park; Millennium Point Car Park; and Snow Hill Multi-Storey Car Park.

This tariff applies to AC charging only and does not apply to Rapid or Ultra-Rapid chargers. Roaming and third-party charging prices may differ.

Customers should refer to the Price Plan Table and the EV Plug In app for the latest pricing and participating locations. All applicable Birmingham City Council parking restrictions, overstay fees and local site regulations continue to apply.

ESB Energy may amend, suspend or withdraw this tariff, including the applicable pricing, charging hours or participating locations, in accordance with its standard Terms & Conditions.

Amendments
ESB Energy reserves the right to amend, suspend or withdraw the tariff, including discount level, hours and participating sites, in line with standard Terms & Conditions. Any changes will be communicated in accordance with ESB Energy’s tariff Terms & Conditions.

*The 'from' pay for use rates refer to the lowest cost for using the network. Check the EV Plug In app for specific charger price details.
